"Where a regularly scheduled meeting is not scheduled within 30 calendar days of the certification of the election results and the resolution of all official election challenges, THE OUTGOING BOARD or the EmpowerLA will call a special meeting within 15 days of the aforementioned criteria being met in accordance with the Brown Act to seat the Board. EmpowerLA shall preside over the meeting where the first order of business shall be to officially seat the newly-elected Board. All powers shall immediately be transferred over to the newly-elected Board.

EmpowerLA staff can work with the OUTGOING BOARD to craft the agenda for the regular or special meeting to ensure a smooth transition between the outgoing and incoming board members. Any leftover business from the outgoing Board will be acted upon by the newly-elected Board members.

A Grievance must be filed within 30 days from the date of the event giving rise to the Grievance. Any Grievance alleging a violation relating to Neighborhood Council funding must be filed within 90 calendar days of the date the expenditure is made.

During a "Special" meeting called to seat the newly-elected Board, the newly-elected executive committee who had yet to be sworn in and appointed to their new seats, cancelled an agenda created by the outgoing board, and proceeded to call to vote items that were not listed on the outgoing Board agenda for the next regular meeting which was cancelled by DONE representatives. The new agenda was created by 4 incoming executive committee members without notice or input from the 5th incoming executive committee member.

In addition to the above, no notice was posted and maintained for public view for at least 24 hours prior to the meeting. I have filed a separate grievance for that violation of the Brown Act.

Remedy

5) Suspension of Neighborhood Council board until mandated trainings are taken by board, board member, or, members.

6) Temporary suspension of Neighborhood Council Funding.

7) Placement of the Neighborhood Council board under control and supervision of the Department.

8) Suspension of individual board member or members.

9) Initiation of de-certification process or process to declare board seats vacant.

Please state why you are seeking the above mentioned remedy or remedies.

I am asking that any votes and BACs be vacated and stricken that came as a result of this meeting. It is in clear violation of the board seating rules to allow a newly-seated board to create an agenda for the Board seating meeting. The outgoing Board has/had the right to proceed with their agenda for the new Board to act upon. Agenda items from the outgoing Board were purposely stricken from the new agenda and they are issues that are important to Board members old and new, as well as in the interest of ALL stakeholders in Sunland Tujunga. The only reasonable remedy is to recall the votes and strike the BACs from the record.
