A Grievance must be filed within 30 days from the date of the event giving rise to the Grievance. Any Grievance alleging a violation relating to Neighborhood Council funding must be filed within 90 calendar days of the date the expenditure is made.

Secretary Stammeich CeSPNC, I once again have to serve you notice of your flagrant disregard of the Brown Act in your constructing meeting notices and crafting agendas, as well as, the allowing of a quorum at the agenda meeting.
At issue are these violations-

Please specify the exact rule and explain the facts of the alleged violation.

1. the attached agenda for the CeSPNC agenda setting meeting is titled EXECUTIVE BOARD & AGENDA SETTING MEETING
Tuesday, August 2nd, 2016, 5:30pm. When in fact 13 members of the Council were in attendance which would make this a de facto board meeting with more than a quorum present. Evidence of this can be obtained from the admin. secretary who took roll call. Although the CeSPNC by laws do not expressly define Executive Board, I believe that Robert's Rules would by explaining them as the "elected officers" of a board or council, of which I believe there are 5 elected officers.
2. the agenda for the "agenda" meeting wasn't even what was presented at the meeting as you brought with you a complete meeting template that included a number of proposed "action" items on the template that should have been noticed in the meeting announcement which were not. (see the posted agenda and refer to the one projected by admin secretary. Two different versions) 3. there seems to be some misconception amongst some of the newly elected council members that former council members, who are still constituent stakeholders, can not speak at these agenda committee meetings. This would be a violation of both CeSPNC by laws and of DONE's rules.
I and my slate team may not have been elected to the new board but you can't by caveat just vote us off of the Island like some survivor reality TV show. There violations and your attempt to vote for a mandatory Pledge of Allegiance at the agenda setting meeting without any notice are continued violations of the Brown Act that can be substantiated by the Admin. Secretary Sheryl and by the Admin. contractor Kristina.
Thusly, if the agenda meeting is not in compliance then the Council meeting can not be in compliance. Please adhere to the rules, laws and by laws.

Remedy

5) Suspension of Neighborhood Council board until mandated trainings are taken by board, board member, or, members.

6) Temporary suspension of Neighborhood Council Funding.

7) Placement of the Neighborhood Council board under control and supervision of the Department.

8) Suspension of individual board member or members.

9) Initiation of de-certification process or process to declare board seats vacant.

Please state why you are seeking the above mentioned remedy or remedies.

The remedy of a Brown Act violation is an immediate redo of the illegal action(s) which in this case would mean reholding the agenda meeting and the monthly stakeholder meeting in the proper sequence and timing.
