A Grievance must be filed within 30 days from the date of the event giving rise to the Grievance. Any Grievance alleging a violation relating to Neighborhood Council funding must be filed within 90 calendar days of the date the expenditure is made.

This filing is against the Mission Hills Neighborhood Council Board with specific action against Jesse Martinez, President..

The below events are in violation of MH Bylaw,s, Article V, Section 6, Paragraph A-C re Vacancies..

-- I've applied for a position on our MHNC for over 3 weeks, as of this writing..

-- Impossible.. The MHNC President Jesse Martinez acts like a dictator..

-- Out of 14 seats, 10 were filled.
Board Meeting scheduled June 6..

-- 2 more resignations just 2 days ago, June 3, 2016.

-- We now have 7 vacancies, as of June 6.

Time Frame/ Chain of communication:

-- I originally sent Jesse Martinez an email. May 8, 2016, asking for Beautification Committee membership.

-- He responded to this same day, indicating no problem.

-- May 9, I then sent a request to the Board, asking for Board appointment.

-- Email rejected improper e address sent to Board @mhnconline org.

-- Sent another e, requesting position May 9, Requesting ) his private email), asking him to fix this mhnc address.

-- No response to request of fixing e address AND asking for Board appt.

-- Mr. Martinez finally replies not until May. 12, stating 1 At Large position open, but 4-5 others applying. WHO & HOW??
He says he's working with Empower LA on these requests. He would keep me appraised.

-- No further response. Why is he working with EmpowerLa? He's trying to bypass the NC Bylaws, and again put his friends on our Board!

-- His email stated do not contact him by email, phone call or txt only, and send nothing unless it's between 9-5..

-- I read the MHNC BYLAWS, said apply in writing; I sent an application, USPS, return receipt requested May 23.

-- I finally received this receipt June 4, signed on June 3, by Jesse..

-- The Bylaws state clearly a stakeholder applying a written application causes the matter to be placed on the agenda..

-- The MHNC AGENDA for meeting June 6, for Item 12, ( see attached), does NOT state my name. It says Possible Action.

-- President Jesse Martinez is acting like an arrogant dictator. The Board members are dropping off like flies, then when someone applys, he's holds up the application stating

-- He & his Board need to develop a form!!

-- Why now?? ALL these years, we've had NO FORM and WHY NOT,

-- And now my application should be sufficient; NOT held up for something new just when the Board is short handed..

NO ONE should have to go through this horrendous process just to become a board member. He's monopolizing this Board.

-- Kathleen Quinn & Jesse decided on the form in our NC Meeting, it was not the Board!!

-- Kathleen is in violation also.

There are other Grievances and I'm filing more reports. Stay tuned in..

Remedy

3) Mandated training for the Neighborhood Council, individual board member, or, members.

4) Required mediation for the Neighborhood Council board, individual board member, or, members.

5) Suspension of Neighborhood Council board until mandated trainings are taken by board, board member, or, members.

6) Temporary suspension of Neighborhood Council Funding.

7) Placement of the Neighborhood Council board under control and supervision of the Department.

8) Suspension of individual board member or members.

9) Initiation of de-certification process or process to declare board seats vacant.

Please state why you are seeking the above mentioned remedy or remedies.

-- Suspension due to his blatant attitude in abusing this and other Bylaws.

-- Total disregard for the welfare of the community.

-- Disregard for Ethics and Code of Conduct. Other a Grievances will be filed, accordingly..

-- Jesse Martinez needs to be held accountable. There are funds in our budget now frozen..

-- 5-7 Committees are dysfunctional..

-- Our Elections were cancelled due to NO viable Outreach ..

--Community of 22,000 residents do not know this organization exists, he's responsible for this..

-- Calendar of Events -- we are notified via email @ approx 3:00 am, then events held @ 9:00 am same day, then no one can attend!!

-- We need help !!
