A Grievance must be filed within 30 days from the date of the event giving rise to the Grievance.  Any Grievance alleging a violation relating to Neighborhood Council funding must be filed within 90 calendar days of the date the expenditure is made.
Article XI, Section A of the DLANC Bylaws states:  “Any grievance by a Stakeholder must be submitted in writing to the Board who shall cause the matter to be placed on the agenda for the next regular DLANC meeting.”

A “writing” (attached hereto) entitled Grievance Pursuant to DLANC Bylaws; Demand for Cure or Correction Pursuant to Brown Act  (“Original Grievance”) was submitted to the Board on March 15, 2016.  Although submitted in accordance with all of the published terms and conditions of DLANC Article XI “Grievance Process,” the matter was not placed by the Board on the agenda for the next regular DLANC meeting.

On March 29, 2016, Alex Hertzberg (Witness Statement attached) was advised by a DONE employee that although the Original Grievance was prepared and submitted in compliance with Article XI of the DLANC Bylaws, it does not meet the requirements of Los Angeles Administrative Code section 22.818 which sets forth a Grievance Process that is substantially different from the process stated in the DLANC Bylaws.  Specifically, the Bylaws do not state a time limit for submitting the “writing” or that the “writing” must be on a specific form.  They also do not state that the grievance must first be submitted to DONE.

By failing to place the duly submitted Grievance on the April 12, 2016 Agenda, the DLANC has violated its stated Bylaws, which is a basis for filing a Grievance pursuant to LAAC section 22.818.

Based on the foregoing facts, the DLANC should be ordered to follow its Bylaws as currently stated and place the Original Grievance on the next regular Board Meeting Agenda to be handled in accordance with the Grievance Process stated in Article XI.  Alternatively, because Grievants had no reasonable notice of any pre-Grievance Process requirements or time limits, then (1) the Grievance they filed with the DLANC on March 15, 2016 and again on the DONE form on April 15, 2016 should be ruled “nunc pro tunc” as timely under LAAC section 22.818, or (2) the 30-day time limit stated in that section should be deemed tolled during the time during which Grievants had no reasonable notice of any requirements other than and in addition to those stated in the DLANC Bylaws so that the 30-days stated in LAAC section 22.818 runs from the date of such actual notice on March 29, 2016.  In addition, the DLANC should be required to amend Article XI of its Bylaws to conform to and give Stakeholders reasonable notice of the requirements of LAAC section 22.818 and DONE’s Grievance Forms.

When you bring additional fields into a conversion, Quickbase often finds inconsistencies. For example, say you're converting your Companies column into its own table. One company, Acme Corporation, has offices in New York, Dallas and Portland. So, when you add the City column to the conversion, Quickbase finds three different locations for Acme. A single value in the column you're converting can only match one value in any additional field. Quickbase needs you to clean up the extra cities before it can create your new table. To do so, you have one of two choices:

  • If you want to create three separate Acme records (Acme-New York, Acme-Dallas and Acme-Portland) click the Conform link at the top of the column.
  • If the dissimilar entries are mistakes (say Acme only has one office in New York and the other locations are data-entry errors) go back into your table and correct the inconsistencies—in this case, changing all locations to New York. Then try the conversion again.
